Everyone has the right to the presumption of innocence. Any person accused of committing a crime is considered innocent if his guilt is not proven in the manner prescribed by law and there is no court verdict that has entered into legal force. If there are reasonable doubts about the guilt of a person, his recognition as guilty is not allowed. A person accused of a crime is not required to prove his innocence. Evidence obtained in violation of the law cannot be used. No one can be found guilty of a crime without a court verdict.

The provision of legal assistance in criminal cases is regulated by the Constitution of the Republic of Azerbaijan, the criminal procedure legislation of the Republic of Azerbaijan, this Law, other legislative acts of the Republic of Azerbaijan and international treaties to which the Republic of Azerbaijan is a party.

Only an advocate who has the right to engage in advocacy in the territory of the Republic of Azerbaijan can participate as a defense counsel in a criminal process. The defense counsel cannot be identified with the identity of the suspect or the accused and the nature of the criminal case involving him. The suspect or the accused may have several defenders. The absence of any of the defenders of the suspect or the accused during the performance of procedural actions in which the participation of the defense counsel is mandatory cannot be grounds for recognizing these actions as illegal.

Protection of a suspect or accused in criminal cases, protection of an individual in proceedings on an administrative offense considered by the court, representation of a person in the Supreme Court of the Republic of Azerbaijan on civil cases and administrative disputes, as well as a complaint about violation of the rights and freedoms of the Republic of Azerbaijan, representation in the Constitutional Court is the exclusive domain of aan advocate.
